Copyright

Starting point

All photos contributed to a Timepin are displayed publicly and anonymously as part of a collective timeline. Contributions are never linked to the name or email address of the contributor. Anonymous contribution is the default.

Moment of consent and licence grant

The copyright licence is granted at the moment the contributor explicitly gives consent for publication. There are two moments of consent:

  • Webapp: the contributor ticks the mandatory consent checkbox before submitting the photo. The text reads: "I have read the terms and agree to publication of this photo as part of the public timeline of [project name]."
  • Mail fallback: sending an email to [email protected] with the project code in the subject line constitutes the moment of consent.

When using the mail fallback the contributor always receives a confirmation email with a summary of the terms, the 7-day opt-out and the statement that the email address will be automatically deleted after 7 days. After the 7-day period has elapsed without objection the licence granted — when submitted via mail — is irrevocable.

When using the webapp no email address is linked to the contribution. Consent runs exclusively via the consent checkbox.

Standard licence (public use)

All images published via Timepins are available under the Creative Commons Attribution — NonCommercial 4.0 International (CC BY-NC 4.0) licence.

This means that third parties may view, share and adapt the images, provided the source is credited (Timepins / the relevant Timepin) and the use is not commercial.

Exception for the Timepin owner

The initiator and owner of a Timepin may also use the collected images for commercial applications directly related to the project, including websites, brochures, annual reports and project-related promotion. This use is non-exclusive.

Use by Timepins

Timepins may use submitted images for promotion of the platform, explanation of projects and fundraising. Timepins is not authorised to sell images separately to third parties.

Ownership

The creator of a photo remains the owner of the image at all times. By submitting a photo the creator grants permission for publication and use as described above.

Statement by the contributor

By submitting a photo the contributor declares that:

  • he or she is the creator of the image or is entitled to publish the image
  • submitting the image does not infringe the rights of third parties, including copyright and portrait rights
  • the image was taken in a public space or was otherwise lawfully obtained
  • Timepins is indemnified against claims by third parties arising from the use of the image

Applicable law

These licence terms are governed by Dutch law. Disputes arising from or connected with these terms are submitted to the competent court in the district of Gelderland, unless mandatory law prescribes a different court.
